Is Using a Fake Medical Certificate Illegal in India? Laws & Consequences

Submitting a forged or fabricated medical certificate carries serious legal, financial and professional consequences in India. Here is what the BNS 2023 says, what employers do, and how courts treat document fraud.

A fake medical certificate is one that records a fictitious examination, is issued without an actual consultation, or is generated using a tool and then presented as a genuine doctor's document. Using such a certificate to obtain leave, claim insurance, condone college attendance, or apply for a statutory licence is a criminal offence in India.

Relevant sections under the Bharatiya Nyaya Sanhita, 2023

  • Section 336 — Forgery, including the creation of a false document with intent to cause damage or injury
  • Section 318 — Cheating, where deception induces another party to deliver property or service
  • Section 340 — Using a forged document as genuine, punishable with the same imprisonment as the underlying forgery
  • Section 227 — False statements made in declarations admissible in evidence

Punishments prescribed by law

Forgery under Section 336 can attract imprisonment up to two years, a fine, or both. Where the forgery is for cheating, Section 318 enhances the punishment to up to seven years imprisonment. If the forged document is an official certificate intended to be used in a court of law or government office, courts have routinely awarded the higher band of punishment.

Civil and disciplinary consequences

Beyond criminal liability, an employee caught using a fake certificate faces immediate termination for misconduct under the standing orders, recovery of wages paid during the bogus leave, blacklisting in background verifications (BGV) databases, and rejection by future employers. Students may face debarment from examinations and cancellation of admission.

How institutions detect fake certificates

HR and admission offices routinely cross-check the doctor's NMC registration number on the public NMC portal, contact the clinic listed on the letterhead, compare signature samples, and use forensic verification of stamps and paper. Several large IT companies and PSUs now use third-party verification agencies that flag suspicious certificates within hours.

Real Indian case law

Indian courts have consistently upheld dismissals based on fake medical certificates. In multiple judgments by High Courts, the right to fair hearing has been observed but the misconduct of submitting a forged certificate has been treated as a grave breach destroying the bond of trust between employer and employee.
