Medical Certificate Rules for Leave in India: Employees and Employers Guide

Sick leave rules in India differ significantly between central government employees, state government employees, factory workers, and private sector staff. The single common thread is the requirement of a medical certificate beyond a defined threshold — usually two or three consecutive days.
Central Civil Services (Leave) Rules, 1972
Central government employees are entitled to 30 days of Half Pay Leave (HPL) per year that can be converted to Commuted Leave on submission of a medical certificate. Earned Leave of up to 300 days can be accumulated. Medical certificates for HPL must be issued by an Authorised Medical Attendant (AMA) under CGHS rules.
State government leave rules
Each state has analogous rules — Maharashtra Civil Services Rules, Tamil Nadu Government Servants' Conduct Rules, Karnataka Civil Services Rules and so on. Most adopt the same 15-day threshold and the same CGHS-style authorisation for medical officers.
Factories Act and Industrial Employment Act
For factory workers, the Factories Act, 1948 and the relevant Standing Orders require medical certificates for absences beyond two days. Workers covered under ESIC must use ESIC dispensary certificates to claim cash sickness benefits.
Shops and Establishments Acts
These state laws govern most office, retail and IT workplaces. Sick leave entitlements range from 7 to 12 paid days a year. Certificates are typically required after 2–3 consecutive sick days, though many HR policies request a certificate for any single-day sick leave applied after a weekend or holiday.
Private corporate HR policies
IT companies, MNCs and large corporates frequently set higher leave thresholds before demanding a certificate — often three to five days. Some require a Return-to-Work fitness certificate before allowing the employee back to the workplace, particularly after surgery, infectious illness, or maternity.
ESIC sickness benefit certificates
Employees earning under the ESIC wage ceiling get cash sickness benefit at 70% of average daily wages for up to 91 days a year. Claims must be supported by Form 9, Form 10 or Form 11 issued by an ESIC Insurance Medical Officer.
Maternity, paternity and adoption leave
Under the Maternity Benefit (Amendment) Act, 2017, women employees are entitled to 26 weeks of paid maternity leave for the first two children. A medical certificate from a registered gynaecologist confirming the expected date of delivery is mandatory for advance claim.
